Terms and Conditions

ELECTRONIC INFORMED CONSENT FOR REMOTE APPOINTMENTS, considering the provisions of MS Ordinance 467/20.

 

This Informed Consent aims to fulfill the ethical duty of informing the patient and their legal guardian, when applicable, about the main aspects related to remote appointments/teleconsultations

Regarding telemedicine appointments:

  1. It complies with Resolution No. 2314/2022 of the Federal Council of Medicine (CFM), which regulates telemedicine actions.
  2. It complies with Law No. 14,510, dated December 27, 2022, which authorizes and regulates the practice of telehealth throughout the national territory, revoking the law of April 15, 2020, and amending Law No. 8,080, from 1990.
  3. Regarding the issuance of prescriptions, reports, and medical certificates remotely, it is valid electronically following the teleconsultation/teleorientation, in accordance with the Ministry of Health Ordinance No. 467, dated March 20, 2020, with the appropriate electronic authentication record.
  4. Patient privacy will be maintained, and all personal data will be preserved under medical confidentiality, including data exchanged through images, text, and/or audio between the doctor and the patient.

 

 

By agreeing to and accepting this informed consent, I declare that:

  1. I am aware that the appointment will be conducted by the company My Doc Abroad, with data stored in a medical record under its custody, complying with the requirements prescribed by the Federal Council of Medicine and the current General Data Protection Law in the country.
  2. I am aware that the appointment is individual, specific to a pre-agreed time and does not guarantee indefinite availability or the doctor’s availability at other non-agreed-upon times.
  3. I am aware that remote appointments may have limitations as they do not allow for a physical examination, which may be limited to video and/or photos in some cases. Therefore, it is even more important to provide all possible information without omitting any details regarding the patient’s health issue, thus contributing to the effectiveness of the remote appointment/teleconsultation.
  4. I am aware that, at the doctor’s discretion, additional tests may be necessary to assist with the diagnosis, which are not included in the fee paid for the medical consultation.
  5. I am aware that, even after the remote appointment, the patient may require an in-person consultation. Additionally, referral to an emergency service may be necessary depending on the severity of the condition or aggravating clinical scenario. I am aware that both are not included in the fee paid for the medical consultation.
  6. I have been informed of the price of the teleconsultation at the time of hiring through the My Doc Abroad platform and that the company will be responsible for issuing and sending the receipt/invoice to the email provided by the patient or legal guardian.
  7. I authorize the use of my email and phone number to receive the teleconsultation link (via email or WhatsApp) or to conduct the teleconsultation via the chosen platform (in the case of WhatsApp), being aware of the vulnerabilities and precautions I should take, acknowledged the risks associated with it.
  8. I am aware that internet connection failures may require the cancellation and rescheduling of the appointment based on availability. I am also aware of the need to test my equipment 15 minutes before the scheduled appointment time.
  9. I commit to preserving and maintaining the confidentiality of images (photos and videos) related to the doctor’s image during the appointment, including data, dialogues, instructions, etc, under penalty of legal sanctions for data and image exposure. Similarly, I affirm my commitment not to record, photograph, or edit any moment of the remote appointment, and I acknowledge that such actions are not authorized by the doctor.
  10. Finally, I declare that I have read the instructions contained in this document, which I fully understand and accept, expressing my full consent to the remote appointment or teleconsultation.

 

 

Regarding cancellation policy:


  1. You can cancel your appointment up to 12 hours before the scheduled time to get a full reimbursement of the payment. 
  2. In case of cancellation of the appointment up to 4 hours before it takes place you’ll receive a reimbursement of 50% of the processed payment.
  3. If the cancellation takes place within less than 4 hours to the consultation you won’t be able to apply for a reimbursement. 
  4. You can reschedule your appointment up to 2 hours before the scheduled time. In case of cancellation of rescheduled appointments you’ll receive a reimbursement of 30% of the processed payment.
  5. If the patient doesn’t answer the calls or doesn’t enter in the videoconference link up to 10 minutes after the scheduled time, the appointment will be considered canceled and the patient won’t be able to apply for a reimbursement.
  6. All the refunds take 5-10 days to appear in your bank statement.
  7. In case of cancellation of the medical appointment by the company My Doc Abroad, you’ll receive a full reimbursement of the payment.
